FIREARM OR OFFENSIVE WEAPON OFFENCES

A ‘zero tolerance’ approach to firearm offences is taken by UK authorities. The steep rise in knife crime means penalties for being caught with an offensive weapon are harsh. Early expert legal advice is therefore essential if you have been charged with such an offence.

Possession of an offensive weapon

If you are suspected or charged with an offence relating to an offensive weapon, our Criminal Defence Solicitors have  alot of experience in acting for defendants. We can support and guide you through the process.

We will accompany you to the crucial police station interviews to ensure you get the best legal advice and that your rights are protected. If you are charged, we will represent you during the court process and seek bail.

We offer a variety of funding options including legal aid. This is dependent on your financial situation and the seriousness of the offence you are accused of.  Alternatively, you may wish to privately fund your defence. We also offer fixed fees where possible to give you certainty of costs before you instruct us.

Possession of a firearm

The possession of a firearm is defined by the Firearms Act 1968 as ‘a lethal barrelled weapon of any description from which any shot, bullet or other missile can be discharged’. Possession of a firearm is tightly regulated in the UK.

To be caught with a gun without a licence could see you jailed for at least five years, even if you did not know you had a firearm in your possession.

Possession of knives, swords, machetes and hammers

Some weapons such as flick knives, swords or machetes are considered offensive weapons. You could be charged with possessing one even if you did not intend to injure someone. Other weapons, such as an axe haft or a work hammer could have an innocent purpose. However, if the police believe you plan to use it to injure someone, you could face charges.

If the police find an offensive weapon on you, you could face up to four years in jail.
